Recent amendments to Canada’s Competition Act have introduced changes to representations to the public concerning the protection or restoration of the environment or mitigating the environmental and ecological causes or effects of climate change (collectively, “Environmental Statements”) unless they can be adequately and properly substantiated in accordance with internationally recognized methodology. There is uncertainty in how these legislative amendments will be interpreted and applied, and we are awaiting guidance from the Competition Bureau regarding them.
